Singer Eun Ga-eun's former agency TSM Entertainment is appealing against the first trial loss in the exclusive contract dispute.
On the 21st, TSM stated, "We humbly respect the first trial court's decision regarding the injunction request for the suspension of the exclusive contract filed by Eun Ga-eun," but expressed their intention to file an immediate appeal against the first trial's judgment.
TSM conveyed their position through the words of the attorney from the law firm representing the company in the first trial. The attorney stated, "The first trial's judgment mainly mentions the basis for the company's settlement, but it seems that the detailed settlement documents, amounting to dozens of gigabytes, provided by the company before the artist's lawsuit were not sufficiently communicated. The fact that nearly 1 billion won was paid to the artist during the exclusive contract period was not judged differently in the first trial. We believe it is better to appeal immediately against the first trial's judgment and explain it sufficiently in the higher court."
In this regard, TSM stated, "After careful consideration, we decided to proceed with the subsequent procedures to show the court that the company has faithfully complied with the exclusive contract and to protect the various affiliated artists who trust and follow the company," and added, "We will sincerely clarify our actions and position in the appeal trial."
Previously, Eun Ga-eun filed an injunction request for the suspension of the exclusive contract against TSM Entertainment in December last year, citing unpaid settlement, breach of trust, and negligence in duties.
In response, the 21st Civil Division of the Seoul Western District Court ruled in favor of Eun Ga-eun on the 19th in the injunction lawsuit against TSM Entertainment.
The court stated, "It is difficult to believe that TSM Entertainment has faithfully fulfilled its settlement obligations under this exclusive contract, as it appears to have excessively settled costs, indicating a significant possibility that the trust relationship has been broken," and "We suspend the effect of the exclusive contract and the supplementary agreement signed between the plaintiff and the defendant in May 2020. The defendant shall bear all litigation costs."
